It has been my experience that in order to get the check from her insurance company you will need to sign a release preventing you from filing further claims, this is sometimes located on the endorsement on the back of the check.

You will need to consider if the expense of legal action (which will also take the current settlement offer off the table) will make you come out ahead of just taking the settlement that has been offered and paying the difference out of pocket.

One of the reasons that I quit driving my 230sl 25+ years ago was because after a fender bender the insurance company of the other driver only offered me $900 to replace my right rear fender, taillight, bumper and rear panel, The repair estimate back then was $1200. I took the advise of our body shop manager to contest the settlement and ended up getting nothing.

Don't take this as legal advise, just my personal worst case scenario.

I hope you can attain a bodyshop who not only can fix your car properly (They would need a proper laser guided frame machine) but will also deal with the big bad insurance company. Unfortunatley many repair shops don't wnat to go head to head with them because it takes time and can be a frustrating process.

Sounds like both you and the other driver are under insured. In NYS the miniums are higher than where you are. In general you should be allowed to have the car properly repaired to the state of previous loss. The repair facility and you will have to be stern with the insurance company to ensure they will pay fair and proper repair procedure time to make the repair right. If the  repair facility takes a short deal and many shops do, you may end up with an inferior job.

This is a lesson for all of us to make sure we have the proper coverage on any of our vehicles let alone carrying an umbrella policy.

Sorry for your loss.

"Totaling" a car simply means either the cost to repair the car is greater than either a) the value of the car once repaired, or b) the total value of the insured's coverage.  I can very easily see this happening.  On Thursday, I saw a C-Class on a frame rack at a local repair facility; it slid sideways and the front clipped a tree.  The requisite body panels were off, and they told me the repair was going to be over $12,000 when completed.  Didn't look like too much to me.

If one has a W113 daily driver, the values for these are all over the board, but generally below $30,000.  Once you hit that $30K mark, the condition of the cars goes up of course, and the pristine cars are upwards from there.

I am not in the insurance business, but if you are making a claim against the insurance company, you should have your facts straight on what your car is worth, and how much coverage you have before or during your coverage; after the fact is a little late, and the ball is in their court so to speak.

This should be a wake up call to all of our members who don't have "collector car" insurance which is a different package altogether than conventional insurance for daily driving.  Daily Drivers: Get a certified appraisal, and use this to get proper coverage BEFORE you have trouble.

With the recent sale of a 113 in London for $130,000, and fine examples fetching high prices, when my renewal came in the other day for collector car insurance (I'm not a daily driver) I bumped my coverage up by about 25%.

If I'm not mistaken (and someone correct me if I'm wrong) I think that damage must exceed 70% of the vehicles value.  When I hit a deer (2nd time) a few years ago with my wifes Maxima we had hoped the insurance company would total the vehichl and to my surprise they opted to fix it.

FYI suicidal critters I have encountered,  two deer, one possum, one racoon, two birds and most recently a three foot aligator.

Interesting side note...the number one killer of humans in the animal world other than us, is deer.

How can you go from $900 to nothing? That sucks! Does that mean your car has been sittin unfixed for that long or you no longer want it on the roads as a result?
